Rape happens both ways and 90% of this goes unreported, but how do you prove it? After marital rape, we should fight for a law that makes it criminal for a husband to watch his wife bathing or in nude without her consent or vice-versa. Our unwillingness to criminalize marital rape (rape of females by males, which is still legal) should force us to ask questions about what marriage means in our society. What are these traditional family values that government is so afraid will weaken if devils who rape their partners are sent to prison? On the other side, criminalizing conjugal rape will put the entire family system under great stress. Dilemma is obvious as our basic value systems are already under threat thanks to proliferation sponsored by liberal sounding cronies, profiteering whores, shrewd celebs, etc .

Is our state really so intent on preserving an outmoded, irrelevant dominance? And if marriages are so resistant to change, so indifferent to female sexuality, so ungenerous and inequitable, is it worth saving? If digital bhakts cannot manage relations, why NOT just scrap concepts like marriage, religious / cultural laws, family, love, trust, truth, etc..? If traditional values mean wealthier will continue to have it all their own way, expect those values to soon be discarded on the dust-heap of an unbecoming history.

Because, when we ask what is the difference between rape and sex, we often say sex is consensual, but a rape is without consent. Whereas agreeing to marry is like giving consent. So the only logical point which can go against this is, if there was violence / extortion / blackmail / torture involved in marital sex. If not, it is indeed a complicated matter. Because there are few who go for wild sex with their spouse under the influence of lust, alcohol or some drugs, which should be punishable. But still it is violent sex, not rape. Because the weak (financially or physically) can complain about the violence involved, but not the act of sex that was done.

So increasing focus on divorce as the legal end of mutual marriage. The thoughts and beliefs toward the marriage system keep changing with time and human rights exploitation for self-benefit. The divorce laws also keeps changing as per the need of time. It is, therefore, necessary to understand the new rules for divorce. Earlier there used to be very few cases of divorce. But with time and now pandemic केमिकल लोचा, mindset of people are changing drastically towards rape, marriage, relations etc.

Grounds of Filing for Divorce

The spouse can file for divorce with when certain conditions are fulfilled. You can file for divorce with mutual consent or without mutual consent.

Some of the general grounds under which a spouse can file for a divorce petition without mutual consent are as follows:

Cruelty: If spouse inflicts any kind of cruelty on partner, you has a right to move the divorce petition. The cruelty inflicted may be physical, mental, emotional, or any other kind. Slapping mother-in-law, insisting for a separate residence, emptying spouse’s bank account and deserting the spouse’s amounts to cruelty.

Desertion: If spouse deserts without any valid reason without informing partner, you obtains a right to get divorced.

Adultery: If spouse carries on any sexual activity outside the wedlock, then person is said to have committed adultery, and you thereby obtains a right to get divorced.

Conversion: If spouse converts to any other religion that he/she was not initially a part of.

Renunciation of the world: If spouse has renounced the world in any other way.

Mental Disorder: If spouse suffers from any mental disease or insanity of any kind whereby he/she becomes incapable of carrying out the normal activities that he/she would have carried otherwise. The Supreme Court observed that each case of schizophrenia has to be considered on its own merits. The medical evidence regarding the requisite degree of mental disorder is relevant though not conclusive.

Gets infected to any venereal disease: If spouse is suffering from HIV/AIDS syphilis, gonorrhoea or a virulent and incurable form of leprosy or any other venereal disease of infectious forms.

Not found for seven years: If spouse is not seen or heard of for seven years, person is presumed to be dead.

So, this is complex and probably a women can understand it better, than men? With injected mutations, the institution of marriage fire is no longer sacred, as it used to be earlier, where chances of divorce are like more than 50% nowadays. It is better for new generations to just go for Live-In relationships or even ancient gandharva or asura type of sex / womb trade, rather than marry. Due to artificial changes in human desires, marriage has lost it’s sense, if divorce is an option and acceptable goals are mostly becoming just family trade for financial / physical benefits.

Right to refuse Maintenance or legal extortion

In many cases, you can also refuse to pay the maintenance to a spouse. Such grounds are:
If the spouse deserts partner.
If commits adultery or cruelty.
If spouse has sufficient means to maintain itself.
If married again to another person.
